Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

  For the purposes of the GDPR where applicable, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity.

  For the purposes of the CCPA/CPRA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.

• Service refers to the Website, the marketplace platform, related communications, Community Channels, and any escrow-related services expressly provided by the Company.
• Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. For the purpose of the GDPR where applicable, Service Providers are considered Data Processors.
• Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
• Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

• Community Channels means OMAR BAY LLC’s official online groups, pages, servers, and similar communities, including “Bay Group” and “Canada Watch Group”, hosted on Discord, Facebook, WhatsApp, and similar third-party platforms.
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. Under the GDPR where applicable, You can be referred to as the Data Subject or as the User as you are the individual using the Service.
• Trusted Dealer or similar status labels reflect only internal or community-based indicators, such as transaction history, member references, account longevity, participation, or limited reviewed information within OMAR BAY LLC communities. Such status does not constitute authentication, endorsement, certification, guarantee, insurance, financial assurance, background screening, due diligence, proof of ownership, or verification of a user’s identity, honesty, legitimacy, products, legal compliance, or future conduct.

Marketplace Role and Escrow

We operate a third-party marketplace platform through which buyers and sellers may connect directly. Except to the extent OMAR BAY LLC expressly agrees to act in a limited escrow or intermediary capacity under separate Escrow Terms or another separate written agreement, We are not a buyer, seller, broker, dealer, merchant of record, consignee, agent, or other party to contracts between users, and We do not control or guarantee payment, delivery, transfer of title, authenticity, legality, condition, or performance of user transactions. When escrow is used, We may process limited identity, payment, and transaction information to verify parties, administer the escrow process, help prevent fraud, and comply with legal obligations, as described in this Privacy Policy. Subject to applicable law, We are not responsible for listing accuracy, user-generated content, or off-platform payment arrangements.

Reference Checks Disclaimer

Reference checks, seller references, transaction feedback, and community opinions available through the Platform or related community channels are provided by users for informational purposes only.

OMAR BAY LLC does not independently verify, investigate, validate, or guarantee the accuracy, completeness, reliability, or truthfulness of any reference, review, reputation statement, transaction history, or similar information shared by users.

No Authentication or Certification

OMAR BAY LLC does not authenticate, inspect, certify, appraise, broker, or guarantee any watch, serial number, movement, component, accessory, provenance, ownership history, title, condition, or listing information posted, transmitted, or offered by users.

Any serial number checks, authenticity reviews, condition inspections, ownership verification, or due diligence procedures are solely the responsibility of the Buyer.

The Platform does not provide professional authentication services and does not guarantee that any item listed is genuine, original, complete, legally owned, or free from modification or counterfeit components.

User Verification

Verification badges or verified account status indicate only that limited account, contact, or identity-related information was reviewed by OMAR BAY LLC for a specific platform purpose.

Verification does not represent or guarantee transaction safety, product authenticity, user honesty, financial reliability, legal compliance, or future conduct.

Identity Verification

Identity verification may be requested only in limited circumstances, including fraud prevention, suspicious activity review, dispute handling, escrow transactions, compliance review, sanctions screening where applicable, voluntary verification requests initiated by the user, platform security, or protection of Our rights and users.

Where appropriate and where it does not interfere with the verification purpose, users are encouraged to redact unnecessary personal information before submitting identification documents, including addresses or identification numbers not reasonably required for the applicable verification purpose.

OMAR BAY LLC seeks to collect only the minimum amount of information reasonably necessary for verification and platform safety purposes.

Identity documents are reviewed only by authorized OMAR BAY LLC personnel or service providers acting on Our behalf. Identity document images are retained only for as long as reasonably necessary to complete the applicable verification process, after which they are generally deleted or securely de-identified within a reasonable period, except where longer retention is reasonably necessary for fraud prevention, an active or anticipated dispute, platform security, enforcement, protection of Our legal rights, or compliance with applicable law, including anti-money-laundering, know-your-customer, and other legal or regulatory obligations applicable in the United States and Canada.

After deletion of identity document images, OMAR BAY LLC may retain a limited verification record, such as the user’s name, account identifier, email address, phone number, verification date, verification method, verification status, document type, last four digits or similar limited reference information where reasonably necessary, and internal fraud-prevention or compliance notes where reasonably necessary.

Data Retention

OMAR BAY LLC retains personal information only for as long as reasonably necessary for fraud prevention, dispute resolution, legal compliance, security, marketplace administration, escrow administration, and operational purposes.

Verification documents are reviewed only by authorized personnel and may be securely deleted or de-identified after verification unless longer retention is reasonably necessary for fraud prevention, dispute handling, legal obligations, platform security, enforcement, or protection of legal rights.

Transaction logs, moderation actions, fraud reports, and compliance records may be retained for longer periods where reasonably necessary to protect users, enforce policies, comply with legal obligations, or defend legal claims.

Retention of Account Contact Information

Even if identity document images are deleted, OMAR BAY LLC may retain certain account-level information, including email address, phone number, username, login identifiers, account history, transaction references, verification status, fraud-prevention notes, and communication records.

This information may be retained as long as reasonably necessary to operate the Platform, maintain account security, prevent fraud, enforce Our Terms of Service, Escrow Terms, and Community Rules, respond to disputes, comply with legal obligations, protect users, and defend legal claims.

Users may request deletion of their account information; however, We may retain limited records where permitted or required by law for fraud prevention, security, legal compliance, dispute resolution, accounting, tax, escrow, or enforcement of Our Terms of Service, Escrow Terms, and Community Rules.

Access, Correction, and Deletion Requests

Subject to applicable law and any permitted limitations or exceptions, users may request access to personal information held by OMAR BAY LLC, request corrections to inaccurate information, request deletion of certain personal information, and, where applicable, withdraw consent to certain processing.

Requests may require identity verification before processing. Certain records may be retained where required for fraud prevention, legal compliance, dispute resolution, platform security, or enforcement purposes.

Security Incidents and Data Breaches

OMAR BAY LLC implements reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, misuse, or loss.

In the event of a security incident involving personal information where notification is required by applicable law, OMAR BAY LLC may notify affected users and applicable authorities in accordance with legal requirements.

Third-Party Platforms and Community Channels

OMAR BAY LLC communities may operate through third-party services and platforms including Facebook, Discord, WhatsApp, Google, Instagram, and similar providers.

These third-party services maintain independent privacy policies and data practices that are outside OMAR BAY LLC’s control. Users are encouraged to review the applicable privacy policies of those platforms before participating.

When You use certain features of the Service, including escrow-related services or certain bank-transfer-related transactions that We expressly support, We may ask You to provide information to facilitate the transaction, verify identity, prevent fraud, assess risk, or comply with applicable law. • Passport, driver’s license, national ID card, or similar government-issued identification
• Bank statement, void cheque, or other limited banking documentation where reasonably necessary to confirm account ownership or facilitate an expressly supported transaction

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is reasonably necessary for the purposes set out in this Privacy Policy, including to provide the Service, maintain appropriate business and tax records, comply with legal obligations, resolve disputes, prevent fraud, enforce Our Terms of Service, Escrow Terms, and Community Rules, handle privacy requests, and protect the Service and Our users.

The Company will also retain Usage Data for internal analysis purposes.
